Terms of Service

1. Agreement to Terms

By accessing or using Playcut, LLC ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

PlayCut is a platform that connects gaming hosts ("Hosts") with players ("Players") through queue management and optional payment features.

2. Definitions

  • "Host" - A user who creates and manages gaming queues on the Platform.
  • "Player" - A user who joins queues to play with Hosts.
  • "Queue" - A managed list of players waiting to play with a Host.
  • "Skip" - An optional payment of PlaySkips made by a Player to prioritize their position in a queue.
  • "Payout" - Earnings transferred from PlayCut to Hosts after a queue session ends.
  • "PlaySkips" - The virtual currency used for all transactions on the Platform.
  • "Gift Pool" - A host-managed pool of PlaySkips contributed by the community toward "Community Goals" (e.g., Sub Gifts).
  • "Platform Fee" - PlayCut's service fee, currently 10% of all paid transactions.

3. Eligibility

Age Requirement

You must be at least 18 years old to use PlayCut. By using the Platform, you represent that you meet this age requirement.

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of unauthorized use

4. User Roles & Responsibilities

4.1 For Hosts

What You Can Do:

  • Create and manage gaming queues
  • Set queue rules (free, hybrid, or paid)
  • Set minimum Skips amounts (minimum 25 Skips as enforced by PlayCut)
  • Accept or reject players
  • Receive payouts for paid queues (minus 10% platform fee)

Your Responsibilities:

  • Provide accurate information about your queue (game, rules, format)
  • Honor your queue settings and commitments to players
  • Respond to players in a timely manner
  • Comply with the game publisher's terms of service
  • Maintain a PayPal account for payouts (required for paid queues)

Prohibited Conduct:

  • Running more than one active queue simultaneously
  • Misleading players about queue terms or wait times
  • Discriminating against players based on protected characteristics
  • Requesting payments outside of the Platform
  • Engaging in fraudulent payout requests

4.2 For Players

What You Can Do:

  • Browse and join queues
  • Use optional Skips to skip ahead in line
  • Rate and review your experience with Hosts
  • Leave queues at any time (refunds subject to Refund Policy)

Your Responsibilities:

  • Follow the Host's queue rules
  • Treat Hosts and other players respectfully
  • Provide accurate information during gameplay
  • Comply with the game publisher's terms of service

Prohibited Conduct:

  • Creating fake accounts or using bots
  • Abusing the Skip system or attempting chargebacks
  • Harassing Hosts or other players
  • Violating any game's terms of service while using PlayCut

4.3 Discord Bouncer Compliance

When using the Discord Bouncer feature, both Hosts and Players agree to:

  • Maintain respectful conduct in automated voice channels.
  • Abide by the "Waiting Room" and "Action Room" flow as managed by the Bouncer.
  • Not circumvent or abuse the automated channel movement system.
  • Grant the Platform necessary permissions to manage Discord voice states for the purpose of moving users between channels.

5. Payments & Fees

5.1 Using Skips

  • Players may optionally use Skips to prioritize their position in paid or hybrid queues
  • All transactions are made using PlaySkips
  • PlayCut takes a 10% platform fee on all transactions
  • Hosts receive 90% of the Skips amount
  • PlaySkips are a virtual currency for accessing premium queue services. PlaySkips are NOT a wagering mechanism, do not represent real money, and cannot be used for gambling, betting, or any form of wagering activity.

5.2 Free Queues

  • Free queues have no payment requirement
  • Players are served on a first-come, first-served basis

5.3 Payment Processing

  • Players purchase PlaySkips via PayPal ("Skip Packs")
  • PlayCut does not store your payment information
  • PlaySkips have no monetary value outside of the PlayCut platform

5.4 Payouts (Hosts)

  • Payouts are processed via the Host Dashboard after a Net-30 security hold.
  • This 30-day window begins once the Skips are earned and is required to handle potential chargebacks and fraud prevention.
  • Hosts must have a valid PayPal account and meet the minimum withdrawal threshold ($50.00) to receive funds.
  • PlayCut is not responsible for payout delays caused by PayPal or banking issues.
  • Hosts are responsible for any applicable taxes on their earnings.

5.5 Tax Compliance

In accordance with IRS regulations, Playcut, LLC is required to collect tax information (Form W-9) from Hosts who choose to withdraw earnings once their lifetime earnings on the Platform reach or exceed $600.00. Payouts will be held until valid tax documentation is provided.

6. Refund Policy

See our separate Refund Policy for detailed information. Key points:

Players:

  • No refunds for completed sessions
  • Partial refunds available if Host cancels queue
  • No refunds for voluntary queue exits

Hosts:

  • Cannot issue refunds directly; contact PlayCut support

7. Referral & Promotional Programs

8.1 Referral Program

PlayCut offers a referral program where existing users can earn promotional PlaySkips by inviting new users to the Platform.

  • Eligibility: Both the Referrer and the Referee must have verified Steam accounts and confirmed email addresses to be eligible for rewards.
  • Bonuses: Referral rewards are provided as "Promotional PlaySkips". These represent promotional value only and carry no cash value.
  • Non-Withdrawable: Promotional PlaySkips are strictly non-withdrawable and cannot be exchanged for cash or transferred outside the Platform.
  • Abuse: PlayCut reserves the right to revoke referral rewards and suspend accounts suspected of referral fraud (e.g., self-referring, botting, or creating fake accounts).

8.2 Promotional Value

Any Skips, bonuses, or value provided to your account for free by PlayCut (promotions, giveaways, referrals) are considered "Promotional Value". Promotional Value is always used first when spending on the Platform and is never eligible for refund or payout.

8. Intellectual Property

8.1 PlayCut Content

All content on the Platform (logos, design, text, graphics, code) is owned by PlayCut and protected by copyright, trademark, and other laws.

8.2 User Content

  • You retain ownership of content you submit (reviews, profile information)
  • By submitting content, you grant PlayCut a worldwide, non-exclusive license to use, display, and distribute your content for operating the Platform
  • You represent that you have the right to submit such content

8.3 Game Content

  • All games and game-related content belong to their respective publishers
  • PlayCut does not claim ownership of any game intellectual property
  • Use of games through PlayCut must comply with each game's terms of service

8.4 User Handles

Selection and use of unique "Handles" (e.g., playcut.gg/username) are subject to the following:

  • Handles are Platform-controlled identifiers and do not constitute your personal property.
  • PlayCut reserves the right, at its sole discretion, to reclaim, reassign, revoke, or block any handle at any time and for any reason, including but not limited to cases of trademark infringement, impersonation, offensive language, or to protect the integrity of the Platform.
  • Users have no right to sell, trade, or otherwise transfer handles to other parties.

9. Privacy & Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Key points:

  • We collect necessary information to operate the Platform
  • We use Supabase for secure data storage
  • We comply with GDPR and CCPA regulations
  • We never sell your personal data

10. Platform Availability

10.1 Service Availability

  • PlayCut is provided "as is" without guarantees of uptime
  • We reserve the right to modify, suspend, or discontinue the Platform at any time
  • We are not liable for service interruptions or data loss

10.2 Beta/MVP Status

  • PlayCut is in early-stage development
  • Features may change without notice
  • We appreciate your feedback and patience

11. Prohibited Activities

You may not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Platform
  • Scrape, data mine, or use automated tools without permission
  • Impersonate others or misrepresent your identity
  • Engage in money laundering or fraudulent activity
  • Use the Platform for gambling or illegal gaming activities

12. Termination

12.1 By You

You may stop using the Platform at any time and delete your account in Settings.

12.2 By PlayCut

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Receive excessive complaints from other users
  • Fail to pay fees owed to PlayCut

12.3 Effect of Termination

Upon termination:

  • You lose access to your account and content
  • Hosts forfeit unpaid earnings below the payout threshold
  • Outstanding disputes will be resolved per our Refund Policy

13. Disclaimers

13.1 No Warranties

PLAYCUT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13.2 Host-Player Relationship

  • PlayCut is a platform only - we do not control Host behavior
  • We are not responsible for the quality of gameplay or Host conduct
  • Disputes between Hosts and Players must be resolved directly or through our support

13.3 Third-Party Services

  • We integrate with PayPal, Supabase, Steam, and Twitch
  • We are not responsible for failures or issues with these third-party services

13.4 Advertising

  • PlayCut may display advertisements to users during queue wait times
  • Ads are served separately from embedded third-party content (Twitch, YouTube, Kick)
  • We do not overlay, block, or modify embedded stream players in any way
  • We comply with all applicable platform Terms of Service for embedded content

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PlayCut's total liability to you is limited to the amount you paid us in the past 12 months or $100, whichever is greater
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for lost profits, data loss, or service interruptions

15. Indemnification

You agree to indemnify and hold PlayCut harmless from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Platform

16. Dispute Resolution

16.1 Informal Resolution

Before filing a claim, you agree to contact us at support@playcut.gg to attempt informal resolution.

16.2 Arbitration (US Users)

Any disputes will be resolved through binding arbitration under the American Arbitration Association (AAA) rules, not in court. You waive your right to a jury trial.

16.3 Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via:

  • Email (if you've provided one)
  • Notice on the Platform

Continued use of the Platform after changes constitutes acceptance of the new Terms.

19. Miscellaneous

19.1 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PlayCut.

19.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

19.3 No Waiver

Failure to enforce any right does not waive our ability to enforce it later.

19.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to a successor or affiliate.

By using PlayCut, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
